1. ACCEPTANCE OF TERMS

Welcome to Test AI Models. By accessing or using our platform at testaimodels.com, you agree to these Terms of Service.

If you don't agree, don't use the Platform.

These Terms are a legal agreement between you and Test AI Models (operated by Marko Milojkovic PR Digital M2, Serbia - Registration Number: 67812549, VAT: 114733003). We may update these Terms occasionally and we'll notify you of significant changes.

2. WHAT TEST AI MODELS DOES

Test AI Models is a platform that lets you:

  • Test AI models (ChatGPT, Claude, Gemini, Grok, and others) with your prompts
  • Compare quality, speed, and API costs side-by-side
  • See results in 30 seconds without providing API keys

We're a testing platform, not an AI provider. We pass your prompts to third-party AI services (OpenAI, Anthropic, Google, xAI, and others) and show you their responses.

Current AI Providers: ChatGPT, Claude, Gemini, Grok, Mistral, Kimi, DeepSeek, Qwen, Perplexity

3. ACCOUNT REGISTRATION AND FREE MODEL TESTS

3.1 Registration

  • You must be 18+ to create an account
  • Provide accurate information (email, password)
  • One account per person
  • You're responsible for account password security

3.2 Free Model Tests

When you create an account, you receive 1 free test per day on the Free plan.

How it works:

  • Resets daily at 00:01 UTC
  • Up to 5 models per test on the Free plan
  • Minimum 2 models per test (for comparison)

Important:

  • The daily free test is available only while you have not purchased credits
  • Once you top up credits, tests run from your credit balance
  • Cannot be transferred, refunded, or exchanged for cash

3.3 After Free Daily Test Is Used

  • You can still access the Platform
  • You can view all your past test results
  • You can browse features and pricing
  • To run more tests the same day, top up credits (Pay as you go) or subscribe to Pro

4. PLANS AND PRICING

4.1 Plan Structure

FREE PLAN

  • 1 free test per day (resets 00:01 UTC)
  • Up to 5 models per test
  • All core features available
  • No credit purchase required to use the daily free test

PAY AS YOU GO

  • Top up credits when you need more tests (minimum $9 USD)
  • Up to 10 models per test
  • x3 markup on API credit purchases
  • Credits roll over and never expire

PRO PLAN ($19/month or $190/year)

  • Lower markup on API purchases (x1.5)
  • Up to 20 models per test
  • First access to new flagship models
  • Priority support

4.2 Pricing

  • Free Plan: $0
  • Pay as you go: from $9 USD minimum top-up
  • Pro Plan: $19 USD per month or $190 USD per year
  • API Credits: Prepaid balance used per test; markup depends on plan (x3 on Free/PAYG, x1.5 on Pro)
  • Prices are in USD, excluding applicable taxes or payment processing fees (VAT added at checkout based on location)

4.3 Price Changes

  • We reserve the right to change pricing with 30 days' notice
  • Existing Pro subscribers are grandfathered at their original price for 12 months

5. API CREDITS SYSTEM

5.1 What Are API Credits?

API Credits are prepaid funds used to pay for AI model API costs when you run tests beyond the Free daily allowance, or after you have topped up.

How It Works:

  • Credits are deducted automatically after each test
  • Markup depends on your plan: x3 on Free / Pay as you go, x1.5 on Pro
  • Example (Pro): A $10 top-up buys approximately $6.67 in provider API usage
  • Example (PAYG): A $10 top-up buys approximately $3.33 in provider API usage

5.2 How Tests Are Charged

Each test consists of multiple model selections. Costs are calculated as follows:

Example Test:

  • You test ChatGPT ($0.04) + Claude ($0.03) + Gemini ($0.01)
  • Total charge: $0.08 in API credits (sum of all models tested)

Pricing varies by:

  • Model used (for example ChatGPT is more expensive than Grok)
  • Prompt length (longer prompts = more input tokens)
  • Response length (longer responses = more output tokens)
  • Each AI provider's pricing

5.3 Minimum Balance Requirement

  • You must maintain a minimum balance of $1 USD in API credits to run tests
  • This prevents tests from failing mid-execution due to insufficient funds
  • If your balance drops below $1, you must purchase more credits to continue

5.4 What If a Test Costs More Than Expected?

  • Tests typically cost $0.005 - $0.5 depending on models and prompt length
  • If a test exceeds your remaining balance:
  • Current behavior: Test completes, we cover the difference, you cannot run new tests until you add credits
  • Future: We may implement real-time balance checks and require pre-authorization for expensive tests

5.5 Purchasing API Credits

Minimum Purchase: $9 USD on Pay as you go (minimum top-up amount shown at checkout)

How to Buy:

1. Click "Buy Credits" in your account

2. Select amount (minimum $9 on Pay as you go, or as shown at checkout)

3. Complete payment via Paddle

4. Credits added to your balance within seconds (webhook processing)

Important:

  • API credits never expire (even if you cancel Pro subscription)
  • If you cancel Pro and later return, your credits are still there
  • Credits are non-refundable once purchased
  • For credits there is additional payment processing fee that Paddle charges us for each payment

6. SUBSCRIPTION MANAGEMENT

6.1 Upgrading to Pro

From Free Plan:

1. Click "Upgrade to Pro" on Plans page

2. Review confirmation page

3. Apply discount code (optional)

4. Redirected to Paddle Checkout

5. Complete payment

6. Pro plan activated immediately

7. Your remaining free model tests are preserved (used first before API credits)

6.2 Managing Subscriptions (Pro Plan)

Pro plan users manage subscriptions via Paddle Customer Portal:

  • Cancel subscription
  • View payment history
  • Download invoices
  • Update payment methods (if needed)

Access Paddle Portal: Subscriptions page then "Manage Subscription"

6.3 Extending Subscription to 12 Months

  • Available from your Subscription page
  • Receive discount for annual commitment
  • Final payment processed via Paddle

6.4 Cancellation

How to Cancel:

  • Navigate to Paddle Customer Portal
  • Click "Cancel Subscription"
  • Cancellation takes effect immediately

What Happens:

  • Access to Pro features stops immediately
  • You cannot run new tests (no API credits can be purchased)
  • Unused API credits are preserved (can use if you reactivate later)
  • Past test results remain accessible
  • You can reactivate anytime by re-subscribing

No Refunds:

  • No refunds for partial months
  • No refunds for unused API credits

6.5 Account Downgrade

  • You cannot manually downgrade from Pro to Free
  • Canceling subscription automatically reverts you to Free plan (with no remaining free model tests)
  • To resume testing, you must re-subscribe to Pro

7. PAYMENT PROCESSING VIA PADDLE

7.1 Payment Processor

All payments are processed by Paddle (Paddle.com Market Limited), our Merchant of Record.

Paddle handles:

  • Payment processing (credit cards, PayPal, etc.)
  • Subscription billing
  • Tax/VAT collection and remittance
  • Invoicing
  • Refund processing (if applicable)

7.2 What You Pay

  • Pro Plan Subscription: $19 USD/month or $190 USD/year + applicable VAT
  • Pay as you go credits: Top-up amount + markup + Paddle fees + applicable VAT
  • API Credits: Credit amount + markup + Paddle fees + applicable VAT

VAT/Tax:

  • Automatically calculated based on your location
  • EU residents: VAT added at checkout
  • Prices shown are excluding tax (tax added during checkout)

7.3 Invoices

  • Automatically sent by Paddle after each payment
  • Available in Paddle Customer Portal
  • Download anytime from your account

7.4 Failed Payments (Pro Plan)

  • If payment fails (card declined, insufficient funds):
  • Paddle retries payment automatically
  • Pro subscription suspended immediately until payment succeeds
  • You cannot purchase API credits during suspension
  • Update payment method in Paddle Customer Portal to reactivate

8. DISCOUNT CODES

8.1 Types of Discounts

We may offer promotional discount codes for:

  • Percentage off subscription (e.g., 20% off first month)
  • Fixed amount off (e.g., $5 off)
  • Free bonus model tests

8.2 How to Use Discount Codes

  • Enter code during checkout confirmation step (before Paddle redirect)
  • Code is validated and applied automatically
  • Discount shown in final price before payment

8.3 Discount Restrictions

  • One discount code per account
  • Cannot be combined with other offers
  • We reserve the right to revoke invalid or abused codes
  • Codes may have expiration dates
  • Non-transferable

8.4 Applying Discount Codes After Signup

  • Discount codes can be applied during checkout or via the cart interface if you are already on a paid plan
  • You still need sufficient API credits to run tests after applying a subscription discount

9. DATA COLLECTION AND USAGE

9.1 What Data We Collect

  • Account data: Email, password (hashed), name (optional)
  • Test data: Your prompts, AI responses, timestamps, models tested, costs, speed
  • Usage data: Which features you use, number of tests, success/failure rates
  • Payment data: Handled entirely by Paddle (we never see card details)

9.2 How We Use Data

  • Provide the Platform service
  • Display your test results
  • Generate community benchmarks
  • Improve the Platform
  • Communicate with you (account updates, support)

9.3 Community Benchmarks (Automatic)

We automatically collect and use the following data for public benchmarks:

  • Speed (how fast each model responded)
  • Cost (how much each model cost)
  • Model selected
  • Thumbs up/down ratings (if you provide feedback)
  • Use case category (what you're building)
  • Reason for model selection (quality, price, speed)

We DO NOT share publicly:

  • Your exact prompt text
  • Your name or email
  • Any personally identifiable information

Example of what we share:

  • "For code generation tasks, Claude was selected 57% of the time"
  • "Average cost for customer support prompts: $0.04"
  • "Gemini Flash is 2x faster than GPT-4o for summaries"

Opt-Out:

  • Currently, all tests contribute to community benchmarks automatically
  • Future feature: Opt-out toggle in account settings (planned)

9.4 What We NEVER Do

  • We NEVER train AI models on your data
  • We NEVER sell your data to third parties
  • We NEVER show your exact prompts publicly

10. REFUNDS AND BILLING DISPUTES

10.1 API Credits Are Non-Refundable

  • Once purchased, API credits cannot be refunded
  • Exception: Technical errors on our end (Platform bug, incorrect charge)
  • Exception: Unauthorized charges (account hacked, fraudulent activity)

  • We'll review on a case-by-case basis
  • We're reasonable and customer-friendly

10.2 Subscription Refunds

  • No refunds for partial months if you cancel mid-cycle
  • Exception: Billing errors or duplicate charges

10.3 Partial Refunds

  • Not available (e.g., can't refund 90 unused credits if you bought 100)
  • Credits never expire, so you can use them later

10.4 Test Failures and Errors

If an AI provider is down:

  • Test continues with working models only
  • You're only charged for successful model responses
  • Failed models show error message
  • You can re-run failed models individually (no extra charge if it was our error)

If test times out (more than 60 seconds per model):

  • All completed model responses are shown
  • You're only charged for completed responses
  • You can re-run timed-out models

11. THIRD-PARTY AI PROVIDERS

11.1 We're a Pass-Through Platform

We send your prompts directly to these AI providers via their APIs:

  • OpenAI (ChatGPT)
  • Anthropic (Claude)
  • Google (Gemini)
  • xAI (Grok)
  • Mistral AI (Mistral)
  • Moonshot AI (Kimi)
  • DeepSeek (DeepSeek)
  • Alibaba Cloud (Qwen)
  • Perplexity (Perplexity)

11.2 You Are Subject to Their Terms

When you use the Platform, you agree to each provider's:

  • Terms of Service
  • Privacy Policy
  • Acceptable Use Policy

11.3 Content Policy Violations

If you violate a third-party AI provider's content policies:

First Offense:

  • Warning email explaining the violation
  • Account remains active

Second Offense:

  • 7-day account suspension
  • No refunds for unused credits
  • Cannot run tests during suspension

Third Offense OR Severe Violations:

  • Permanent account ban
  • No refunds
  • We may report illegal activity to authorities

Severe violations include:

  • Child sexual abuse material (CSAM)
  • Terrorism or violent extremism
  • Human trafficking
  • Other illegal content

Our Position:

  • We're not liable for what you generate
  • But we cooperate with law enforcement
  • We reserve the right to terminate accounts for policy violations

11.4 No Liability for Third-Party Services

  • We don't control AI model outputs
  • We're not responsible for accuracy, quality, bias, or legality of responses
  • If an AI provider is down, we can't run tests for that model
  • Third-party data policies apply (we don't control what they do with your prompts)

12. INTELLECTUAL PROPERTY AND OWNERSHIP

12.1 Your Content

  • You own your prompts (the inputs you provide)
  • You own your test results (the Platform data you generate)
  • You can use test results for any purpose (blog posts, client reports, internal decisions)

12.2 AI Model Outputs

  • AI responses are subject to each provider's terms
  • Most providers grant you ownership of outputs (check their terms)
  • We don't claim ownership of AI outputs
  • You're responsible for verifying you have rights to use AI outputs commercially

12.3 Platform Intellectual Property

  • Test AI Models name, logo, and Platform design are our property
  • You cannot copy, modify, or distribute our Platform code
  • You cannot reverse-engineer our Platform
  • You cannot resell or white-label our Platform

12.4 Community Benchmark Data

  • We may publish anonymous aggregate statistics publicly
  • We may use aggregate data in blog posts, reports, marketing
  • Individual prompts or user data are never shared

13. PROHIBITED USES

13.1 You May NOT Use the Platform To:

  • Generate illegal, harmful, or hateful content
  • Violate third-party intellectual property
  • Harass, threaten, or harm others
  • Create multiple accounts to abuse free model tests
  • Scrape, crawl, or automate requests (without permission)
  • Resell or redistribute Platform access
  • Attempt to hack, exploit, or disrupt the Platform
  • Violate third-party AI provider policies
  • Use the Platform for any unlawful purpose

13.2 Rate Limiting and Abuse Prevention

  • Currently, no automated rate limits
  • We manually review suspicious accounts
  • Excessive usage may trigger manual review
  • We reserve the right to suspend or ban accounts for abuse

13.3 Consequences

If you violate these rules:

  • First offense: Warning
  • Second offense: 7-day suspension
  • Third offense or severe violations: Permanent ban
  • Forfeited unused credits (no refund)
  • We may report illegal activity to authorities

14. API KEY SECURITY

14.1 We Handle API Keys

  • You do NOT provide API keys, we use our own
  • Our API keys are stored securely (encrypted at rest)
  • Server-side workflows only (never exposed in frontend)
  • Keys are rotated regularly for security

14.2 Timeout Protection

  • Each model test has a 60-second timeout
  • If a model doesn't respond within 60 seconds, that specific model result times out
  • Other models in the same test continue running
  • You can re-run timed-out models individually

14.3 Duplicate Test Prevention

  • If you accidentally double-click "Test" button, you are charged twice
  • We currently don't have duplicate detection
  • Be careful when clicking "Run Test"

15. DISCLAIMERS AND LIMITATIONS OF LIABILITY

15.1 Platform Provided "AS-IS"

  • The Platform is provided without warranties of any kind
  • We don't guarantee:
  • Uptime or availability
  • Accuracy of AI responses
  • Suitability for your specific purpose
  • Error-free operation
  • Specific cost savings

15.2 No Liability for AI Outputs

  • We're not responsible for:
  • Inaccurate, biased, or harmful AI responses
  • Copyright violations in AI outputs
  • Business decisions based on test results
  • Losses from using AI model recommendations
  • Third-party AI provider outages or errors

15.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our liability is limited to the amount you paid in the last 12 months
  • Maximum liability: $100 USD or amount paid, whichever is greater
  • We're not liable for indirect, consequential, or punitive damages
  • This includes lost profits, data loss, or business interruption

15.4 Use at Your Own Risk

  • You're responsible for verifying AI outputs before using them
  • Test results are for comparison purposes only
  • Make your own informed decisions about AI model selection
  • We're a testing tool, not a decision-making service

16. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of third-party rights (including AI provider terms)
  • Content you submit to the Platform
  • Any illegal or harmful content you generate using AI models

17. DATA DELETION AND ACCOUNT MANAGEMENT

17.1 Deleting Tests

  • You can delete individual tests from your test history
  • Deleted tests are removed within 30 days
  • No recovery after deletion

17.2 Deleting Your Account

  • Click "Delete Account" in account settings
  • Confirmation required (irreversible action)
  • All data deleted within 30 days:
  • Account information
  • Test history
  • Prompts and responses
  • Usage data

What's NOT deleted:

  • Payment records (required by law for tax compliance)
  • Aggregate statistics (anonymized, no longer linked to you)

17.3 Account Retention

  • If you don't delete your account, data is retained indefinitely
  • Free plan: All test results remain accessible
  • Pro plan: All test results remain accessible
  • Canceled Pro plan: Test results remain accessible, but you can't run new tests

18. TERMINATION

18.1 You Can Leave Anytime

  • Cancel your subscription via Paddle Customer Portal
  • Delete your account in account settings
  • No penalties or fees for leaving

18.2 We Can Terminate Your Account If:

  • You violate these Terms
  • You abuse the Platform (multiple accounts, excessive usage)
  • Payment fails repeatedly (Pro plan)
  • Required by law
  • Severe content policy violations

18.3 Effect of Termination

  • Access to Platform ends immediately
  • Unused API credits are forfeited (no refund)
  • We may retain data as required by law (payment records for taxes)
  • Sections 11, 12, 14, 15, 16, and 19 survive termination

19. DISPUTE RESOLUTION

19.1 Governing Law

  • These Terms are governed by the laws of Serbia
  • Disputes are subject to the exclusive jurisdiction of Serbian courts

19.2 Informal Resolution First

  • Before filing a lawsuit, contact us at info@testaimodels.com
  • We'll try to resolve disputes informally within 30 days
  • Most issues can be resolved through communication

19.3 Arbitration (Optional)

  • For disputes under $10,000 USD, we may agree to binding arbitration
  • Arbitration is faster and cheaper than court
  • Both parties must consent to arbitration

20. GENERAL PROVISIONS

20.1 Changes to Terms

  • We may update these Terms with 30 days' notice
  • Notice will be sent via email or Platform notification
  • Continued use after changes means you accept new Terms
  • Material changes require explicit consent

20.2 Entire Agreement

  • These Terms constitute the entire agreement between you and us
  • Supersedes all prior agreements or understandings

20.3 Severability

  • If any provision is invalid or unenforceable, the rest remains in effect

20.4 No Waiver

  • Our failure to enforce a provision doesn't waive our right to enforce it later

20.5 Assignment

  • You cannot transfer your account or these Terms to another person
  • We may assign these Terms (e.g., if the business is acquired)

20.6 Force Majeure

  • We're not liable for delays due to events beyond our control:
  • Natural disasters
  • Pandemics
  • War or terrorism
  • Government actions
  • Third-party AI provider outages
